SUGGESTED EMPLOYMENT CODE.
An Ordinance to regulate and consolidate the law
relating to employment.
Be it enacted by the Governor of Hong Kong with the advice and consent or the Legislative Council thereof as follows:-
1. This Ordinance may be cited as the Employment Code 1951. 2. In this Ordinance, unless the context otherwise requires
"Agreement" means any verbal contract of service; "child" means any person under the age of 14 years; "collective agreement" means any agreement concerning wages and conditions of employment entered into by employers and a registered trade union or the workers of an individual concern acting collectively through elected representatives;

"Commissioner" means any person appointed by the Governor to be the Commissioner of Labour or Acting Commissioner of Labour;
"contract of service" means any written contract of service;
"employer" includes any person, firm, corporation or company who or which enters into any agreement or contract of service with any worker as hereinafter defined and the agent of any such person, firm, corporation or company;
"forced labour" means any work or service which is extracted from any person under the menace of any penalty and for which the said person has not offered himself voluntarily but shall not include
(a) any work or service extracted in virtue of
compulsory military service for work of હૈ military character;
(b) any work or service which forms part of the
normal civic obligations of a citizen;
(c) any work or service extracted from any person
as a consequence of conviction in a court of law provided that such work or service is carried out under the supervision and control of a public authority;

(a) any work or service extracted in cases of
emergency.
"worker" "means any person employed on an agreement or contract of service whose total remuneration does not exceed four hundred dollars per mensem.

Preliminary.
3. The Governor in Council may from time to time frame
rules or orders for the conduct of duties under this Ordinance.
4. (1) The Commissioner shall have power, subject to such
limitations as the Governor in Council may by rule provide, to delegate to officers of the Department of Labour any or all of the duties imposed or powers conferred on him by this Ordinance; and every duty so performed and power exercised shall be deemed to have been duly performed and exercised for the purpose of this Ordinance.
